Common Council Meeting Minutes – November 18, 2019

Council President Eric Bowlen called the Martinsville Common Council to order on Monday, November 18, 2019. Ben Merida led the Prayer to those in attendance. Council President Bowlen then led the attendees in the Pledge of Allegiance.

A quorum was declared present.

MINUTES

A motion was made by Councilman Chip Keller to waive the reading of the minutes of November 4, 2019 and to accept the minutes as written. Councilman Terry Buster seconded the motion. The Motion passes 7-0.

MAYORS REPORT

None

ENGINEER’S REPORT

Troy Swan, with HWC, reported that he had received several phone calls requesting information on the recent storm water/sewer rate increases. He will put together some information and examples to better explain the rate increases. The information will be put into future billings and posted to the City’s Facebook page.

OLD BUSINESS

Ordinance 2019-1810 / Additional Appropriation Sanitation and Police – Ben Merida presented the ordinance for the second reading. A motion to close the Council meeting was made by Councilman Phil Deckard II. Councilman Mike Lanam seconded the motion. The Motion passes 7-0.
A motion to open the Public Hearing was made by Councilman Mike Lanam, with Councilman Phil Deckard II seconding. The Motion passes 7-0.

PUBLIC HEARING

Council President Bowlen called three times for Public Comment regarding the additional appropriation. Councilman Phil Deckard II asked about the rates at the transfer station and suggested reviewing the rates at the conclusion of the current contract. There were no other comments or questions.

Councilman Phil Deckard II made the motion to close the Public Hearing. Councilman Kris Fuller seconded the motion. The Motion passes 7-0.

A motion to reconvene the Council meeting was made by Councilman Phil Deckard II. Councilman Kris Fuller seconded the motion. The Motion passes 7-0.

A motion to accept and allow Ordinance 2019-1810 was made by Councilman Phil Deckard II. Councilman Mike Lanam seconded the motion. The Motion passes 7-0.

CDBG Wastewater/Drinking Water Program. A motion to close the Council meeting was made by Councilman Phil Deckard II. Councilman Chip Keller seconded the motion. The Motion passes 7-0.

A motion to open the Public Hearing was made by Councilman Phil Deckard II, with Councilman Chip Keller seconding. The Motion passes 7-0.

PUBLIC HEARING

Council President Bowlen called three times for Public Comment regarding the additional appropriation.

Trena Carter, with ARA, presented the program. She mentioned several things that this program would address: including updating the current well field and any corresponding costs.

Citizen Kenny Costin questioned the verbiage of the grant and would like the well field location to be flexible in the grant wording.

Troy Swan, with HWC, mentioned that the PER specified the current well field location. He also stated that if the well field location were to be moved then the process of obtaining the funding and the grant process would have to start over.

Employee Jake Millis stated that a water treatment facility would have to be located wherever the wellfield is.

Councilman Chip Keller stated that he would prefer to keep things as already planned and proceed.

There were no other comments or questions.

Ordinance 2019-1811/Police Merit Board – Chief of Police Rodger Wiltermood and Deputy Chief John Richards appeared to explain the need for a Merit Board. The Board would consist of two appointees by the Mayor, two by the Police Department and one from Council. A motion to accept and allow was made by Councilman Phil Deckard II. Councilman Terry Buster seconded the motion. The Motion passes 7-0.Ordinance 2019-1812/Fire Merit Board –Deputy Chief Charles Fraker appeared to explain the need for a Merit Board. The Board would consist of two appointees by the Mayor, two by the Fire Department and one from Council. A motion to accept and allow was made by Councilman Phil Deckard II. Councilman Kris Fuller seconded the motion. The Motion passes 7-0.

NEW BUSINESS

Signatory Authorization Resolution 2019-590 – Trena Carter, ARA- A motion to accept and allow was made by Councilman Chip Keller. Councilman Terry Buster seconded the motion. The Motion passes 6-1 with Councilman Kris Fuller voting against.

Safety Committee – Ben Merida – Deputy Clerk Ben Merida asked the council if he could draft a resolution to form a safety committee. The draft of the resolution will be presented at a future meeting.

Water Quality Update – Scott Manley – Employee Scott Manley presented a water quality updated. He also passed around a sample of the filtering system for everyone to see. The current filters appear to be holding up well and will not need to be replaced until the calendar 2020 sometime. Several questions were asked and answered on the types of tests performed.

Resolution 2019-587/ Amend Economic Development Area – Councilman Chip Keller presented the resolution. A motion to accept and allow was made by Councilman Chip Keller. Councilman Ben Mahan seconded the motion. The Motion passes 7-0

Resolution 2019-589/ Temporary Loan General to City Liability Insurance – Deputy Clerk Ben Merida presented the resolution. A motion to accept and allow was made by Councilman Mike Lanam. Councilman Chip Keller seconded the motion. The Motion passes 7-0

CLAIMS

A motion to accept and allow the claims as reported was made by Councilman Terry Buster. Councilman Phil Deckard II seconded the motion. The Motion passes 7-0.

MISCELLANEOUS

Police Chief Wiltermood stated the to the council that he will be presenting ordinances in the future to establish parking violation amounts.

There being no further business, Councilman Kris Fuller made a motion to adjourn. This was seconded by Councilman Terry Buster. The Motion passes 7-0.
