Common Council Meeting Minutes – June 22, 2020

Mayor Costin called the virtual meeting Martinsville Common Council to order on Monday, June 22, 2020.  Chaplain Ross Cochrum led the prayer, followed by Mayor Costin leading the Pledge of Allegiance.

A quorum was declared present.

MINUTES

Mayor Costin presented the Minutes of June 8, 2020 to the Council.  There being no objections, the Minutes were approved by unanimous consent.

MAYOR’S REPORT

Special Recognitions – Mayor Costin presented former councilman, Eric Bowlen with a key to the City for his service.  Mayor Costin presented Dallas Tincher with a Proclamation to declare June 30th “Dallas Tincher Day.” Tincher is retiring from the City.

NEW BUSINESS

Messmer Holdings, LLC / Thrive LLC / Vacate Alley – James Wisco, attorney for Messmer Holdings, LLC and Thrive LLC, appeared to request the alley in the area of Curtis Construction, be vacated.  A motion to recess the Council meeting for a Public Hearing was made by Councilman Phil Deckard II.  Phil Deckard Sr. seconded the motion.  The Motion passes 6-0.

A motion to open the Public Hearing was made by Councilman Phil Deckard Sr. with Councilman Phil Deckard II making the second.  The Motion passes 6-0.

PUBLIC HEARING

Mayor Costin called for public comments regarding the issue.   James Wisco reported that the area in question had once been a street over 100 years ago.  His client had purchased the property at a Sheriff’s Sale and during the title search, it was discovered the area was not part of the parcel.  Wisco distributed maps of the area to the Council.

Mayor Costin called three additional times for Public Comment.  There being none, Councilman Phil Deckard II made the motion to close the Public Hearing.  Councilwoman Ann Miller seconded the motion.  The Motion passes 6-0.

A motion to reconvene the Council meeting was made by Councilman Phil Deckard II.  Councilman Phil Deckard Sr. seconded the motion.  The Motion passes 6-0.

A motion to accept and allow the alley to be vacated was made Councilman Phil Deckard Sr.  Councilwoman Ann Miller seconded the motion.  The Motion passes 6-0.

Ordinance 2020-0005 – City Attorney Dale Coffey presented the ordinance that will allow the alley to be vacated foe Messmer Holdings, LLC. and Thrive, LLC.  A motion to accept and allow was made by Councilman Phil Deckard II with Councilwoman Ann Miller making the second.  The Motion passes 6-0.

Police Chief Kurt Spivey / Surplus Items – Chief Spivey presented a list of items from the Police Department.  Spivey requested the items be declared surplus and to be allowed to dispose of the items.  A motion to accept and allow was made by Councilman Chip Keller.  Councilman Phil Deckard II seconded the motion.  The Motion passes 6-0.

CLAIMS

A motion to accept and allow the claims was made by Councilman Phil Deckard II.  Making the second was Councilman Ben Mahan.  The Motion passes 6-0.

MISCELLANEOUS

Councilman Phil Deckard Sr. requested a discussion concerning South Street.

Election of a new Council President resulted in a stalemate. It was agreed to wait until a new Council person is elected before voting again.  The nominations of Phil Deckard II and Chip Keller will remain in effect.

Councilman Phil Deckard II expressed concerns regarding the new overpass at South and I-69.  Bike traffic is allowed and Councilmen Deckard II and Keller, thought there could be a liability issue for the City.

It was agreed a special work session will take place on Tuesday, June 30th at 4:00 p.m. will occur.  The Public is allowed, but no comments will be allowed.
