Board of Zoning and Appeals Meeting Minutes – January 26, 2021

The Martinsville Board of Zoning Appeals was called to order by Chairman Ann Marvel at 6:00 PM on Tuesday, January 26, 2021, in the Council Chambers of City Hall, Martinsville, IN.

ATTENDANCE

Those members present were:
President Ann Marvel;  Vice-Chairman Katie Barnard;  Secretary Marilyn Siderewicz;  Anna Elliott; and Tom Hacker.

Also in attendance:
Bob Strader, Building Inspector
Dale Coffey, Board Attorney

APPOINTMENT OF OFFICERS FOR CALENDAR YEAR 2021:

MOTION:  Katie Barnard made a motion to elect Ann Marvel as Chairman.  The motion was seconded by Marilyn Siderewicz and passed unanimously.

MOTION:  Katie Barnard made a motion to elect Anna Elliott as Vice-Chairman.  The motion was seconded by Tom Hacker and passed unanimously.

MOTION:  Ann Marvel  made a motion to elect Marilyn Siderewicz as Secretary.  The motion was seconded by Katie Barnard and passed unanimously.

MINUTES:    A motion was made by Anna Elliott to approve the minutes of the December 15, 2020, meeting.  This motion was seconded by Tom Hacker and passed unanimously.

OLD BUSINESS:  

1.Docket No. BZA20-12001: Use Variance request to construct a commercial kitchen in the garage; property address:  219 N. Ohio Street; PID #55-09-33-482-006.000.021; Legal Description:  Lot 7 Blk 5 Cunningham’s 1st Addition; Owner – Tracy Harvey.

Tracy Harvey, owner of the property at 219 N. Ohio Street, was not present at the meeting to make the request.   The necessary paperwork had not been returned.

MOTION:   Marilyn Siderewicz made a motion to dismiss the request at this time.       The motion was seconded by Tom Hacker and passed unanimously.

Attorney Dale Coffey said since the case was dismissed by the Board, the petitioner would have to wait three months to reapply for the Use Variance request.

NEW BUSINESS:

A. New sign placement in Overlay District – 1819 E. Morgan Street; PID #55-09-34-465-004.000-021; Legal Description: Lots 9, 10, 11 C & F Commercial Area; Owner:  DMG Property Group – Deric Gayde.

The overlay district runs along the interstate and is 1,000 ft. wide on both sides of the road.   The overlay gives the city authority over construction and development close to the interstate.   The sign for the storage business on East Morgan Street would need board approval.

The sign for Storage 360 will be located alongside East Morgan Street by the business.

Attorney Coffey said there were no conditions to consider but approval was required under the city’s zoning ordinance.

MOTION:  Anna Elliott made a motion to approve the placement of a new sign in the Overlay District, 1819 E. Morgan Street as requested by the DMG Property Group, Deric Gayde.   The motion was seconded by Marilyn Siderewicz and passed unanimously.

B. New sign placement in Overlay District – 670 Birk Road, PID #55-13-03-380-002.000-021; Legal Description: Lot 6B Grand Valley Center Amended Sec 2, 1.826ac; Owner:  Home Bank SB – Bob Breeden, Home Bank and Kevin Sims, Green Sign Company.  

Kevin Sims, Green Sign Company, was present at the meeting and gave the presentation.  The sign for Home Bank would be located close to its branch office in Grand Valley.

MOTION:  Marilyn Siderewicz  made a motion to approve the new sign placement in the Overlay District, 670 Birk Road, as requested by Bob Breeden, Home Bank, and Kevin Sims, Green Sign Company.      The motion was seconded by Tom Hacker and passed unanimously.

C. Docket #BZA21-01001: Approval for billboard placement – 420 St. Rd. 39 Bypass; PID #55-13-04-118-001.000-021; Legal Description:  S4 T11 R1E Pt W ½ NW l.006ac; Landowner:  Ohab A. Fyzal:  Billboard easement owner:  Dale S. Snead; JR Promotions LLC – Rick Sprague and Ray Lady.

Mr. Rick Sprague asked that the request to place a billboard in the 400 block of IN 39 Bypass be continued until the February 23, 2021, meeting.

MOTION:  Anna Elliott made a motion to grant the request for continuance until the February 23, 2021, meeting.   There was a second to the motion by Katie Barnard, and it passed unanimously.  The request was to place a billboard in the 400 block of IN 39 Bypass.

OTHER BUSINESS:    None.

NEXT SCHEDULED MEETING:    The next regularly scheduled meeting of the Martinsville Board of Zoning Appeals will be Tuesday, February 23, 2021, at 6:00 PM.

ADJOURNMENT:  There being no further business, the meeting adjourned with a motion by Ann Marvel, seconded by Tom Hacker, and passed unanimously.
