Board of Zoning and Appeals Meeting Minutes – April 27, 2021

The Martinsville Board of Zoning Appeals was called to order by Chairman Ann Marvel at 6:00 PM on Tuesday, April 27, 2021, in the Council Chambers of City Hall, Martinsville, IN.

ATTENDANCE

Those members present were:
President Ann Marvel; Vice-Chairman Katie Barnard; Secretary Marilyn Siderewicz; Anna Elliott; and Tom Hacker.

Also in attendance:
Bob Strader, Building Inspector
Dale Coffey, Board Attorney

PRESENTATION OF THE MINUTES:

MOTION:   A motion was made by Katie Barnard to approve the minutes of the January 26, 2021, Meeting.  This motion was seconded by Anna Elliott and passed unanimously.

UNFINISHED BUSINESS:  

A. Docket No. BZA21-01001: Approval for billboard placement – 420 St. Rd. 39 Bypass; PID #55-13-04-118-001.000-021; Legal Description:  S4 T11 R1E Pt W1/2NW l.006ac; Landowner:  Ohab A. Fyzal:  Billboard easement owner:  Dale S. Snead; JR Promotions LLC – Rick Sprague and Ray Lady.

Mr. Richard Sprague said the present sign is wooden and has been there many years.   The proposed electronic sign would change its message about every 8-10 seconds.   The changing of the message would be done in the office.   This sign would post local events and amber alerts.

Gary Oakes reported that the area in question was located on the 39 Bypass, in the area of the Cooper Tire Company.   He felt this would be a safety issue.

Bob Strader, Building Inspector, stated that this would be about 500 ft. from condominiums.

Attorney Dale Coffey reported that no Findings of Fact had been presented.

MOTION:   Tom Hacker made a motion to deny the request for approval of a billboard placement at 420 St. Rd. 39 Bypass at this time due to safety issues.      The motion was seconded by Anna Elliott and passed unanimously.

NEW BUSINESS:

A. Docket #BZA21008: Requesting a variance to place 8-foot privacy fence on the east side of property; Property address:  2279 E. Country Club Road; PID #55-09-26-230-002.000-020:  Legal Description:   Lot 5 Country Club Estates; Owner:  Diane Selch.  

Bob Strader, Building Inspector, requested that this request be tabled until the next month for discussion.

MOTION:     Tom Hacker made a motion to table the request for a variance to place an 8-foot privacy fence on the east side of the property at 2279 E. Country Club Road as requested by Diane Selch.   The motion was seconded by Marilyn Siderewicz and passed unanimously.

NEXT SCHEDULED MEETING:    The next regularly scheduled meeting of the Martinsville Board of Zoning Appeals will be Tuesday, May 25, 2021, at 6:00 PM.

ADJOURNMENT:  There being no further business, the meeting adjourned with a motion by Anna Elliott, seconded by Katie Barnard, and passed unanimously.
