Board of Zoning and Appeals Meeting Minutes – September 28, 2021

The Martinsville Board of Zoning Appeals was called to order by Chairman Ann Marvel at 6:00 PM on Tuesday, September 28, 2021, in the Council Chambers of City Hall, Martinsville, IN.

ATTENDANCE

Those members present were:

President Ann Marvel;  Katie Barnard;  Secretary Marilyn Siderewicz;  and Anna Elliott, Vice-Chairman.

Absent:   Tom Hacker.

Also in attendance:  Bob Strader, Building Inspector, Dale Coffey, Board Attorney

PRESENTATION OF THE MINUTES:

MOTION:   A motion was made by Anna Elliott to approve the minutes of the August 24,  2021, Meeting.  This motion was seconded by Katie Barnard and passed unanimously.

NEW BUSINESS:

A. Docket #BZA21022: Special Exception Variance to install an electronic message center/sign across the street from a residential area.  Location:  Poston Road Elementary School 139 E. Poston Road – Green Sign Company, LLC.

Lauren Oberdorf of the Green Sign Company, LLC, made the presentation to the Zoning Board.   Mr. Oberdorf stated that a Special Exception Variance was needed to install an electronic message sign due to the sign’s close proximity to a residential area.   This new sign would replace the old sign.

Chairman Ann Marvel stated that this request meets all the requirements.    A Findings of Fact for Special Exception was submitted and found to be acceptable.

REMONSTRATORS:

Darrell Gray, 1340 South Ohio Street.  Mr. Gray asked the Board to consider setting parameters for when the sign would be illuminated.

Sam Arnes, Director of Operations, Metropolitan School District of Martinsville, gave an Authorization Approval.

MOTION:   Katie Barnard made a motion to approve the request for special exception variance for Green Sign Company, LLC, to install a sign with an electronic message display at Poston Road Elementary School with the stipulation the sign will not be illuminated from l0 PM. to 5 AM.  The motion was seconded by Anna Elliott and passed unanimously.

OTHER BUSINESS:    None.

NEXT SCHEDULED MEETING:    The next regularly scheduled meeting of the Martinsville Board of Zoning Appeals will be Tuesday, October 26, 2021, at 6:00 PM.

ADJOURNMENT:  There being no further business, the meeting adjourned with a motion by Marilyn Siderewicz, seconded by Anna Elliott, and passed unanimously.
