Board of Zoning and Appeals Meeting Minutes – October 26, 2021

Board Of Zoning Appeals

The Martinsville Board of Zoning Appeals was called to order by Chairman Ann Marvel at 6:00 PM on Tuesday, October 26, 2021, in the Council Chambers of City Hall, Martinsville, IN.

ATTENDANCE

Those members present were:
President Ann Marvel; Katie Barnard; Secretary Marilyn Siderewicz; Vice Chairman Anna Elliott; and Tom Hacker.

Also in attendance: Bob Strader, Building Inspector
Dale Coffey, Board Attorney

PRESENTATION OF THE MINUTES:

MOTION: A motion was made by Katie Barnard to approve the minutes of the September 28, 2021, Meeting. This motion was seconded by Anna Elliott and passed unanimously.

NEW BUSINESS:

A. Docket #BZA21023: Development Standards Variance to reduce front setback from 85’ to 30’ from the center of the road; address 172 N. Old St. Rd. 67 South. Owners. Brandon and Viola Sichting.

The Board members were given drawings of the property and what was proposed to be done. The request is for a variance for the front setback to be changed from 85 ft. to 30 ft.

Bob Strader, Building Inspector, said that he had visited the property on three occasions and had measured the area. He was concerned about water from the hillside. Mr. Strader said there was a small ditch that could be cleaned by the county. There was no erosion.

Chairman Ann Marvel asked if they are aware of the need for the ditch to be cleaned.

Mr. Strader further stated that there has been no septic system approval.

Attorney for the Board, Dale Coffey, read the Findings of Fact and found them to meet the standards.

Brandon Sichting, owner of the property, said that Chris Kline built l0 to 15 ft. from the hillside and the water was checked and found to be alright.

REMONSTRATORS

None.

MOTION: Tom Hacker made a motion to approve the request, as presented, for Development Standards Variance for property located at 172 North Old State Road 67 South, as requested by Brandon and Viola Sichting. The motion was seconded by Katie Barnard and passed unanimously.

DOCKET #BZA 21024: Development Standards Variance to construct a single family home across the lot line (reduced setback) on the following lots:

2081 N. Wolf Cove Lot 5 Wolf Laurel Sec 1 55-09-22-370-005.000-020

Owner: Kevin Shingleton

Mr Shingleton, owner of Lot 4 and Lot 5 in the Laurel Ridge Estates requested a variance to build across the lot line (requested a reduced set back).

Drawings showing the area and details of what he intends to do with the property were distributed to the members of the Board.

Bob Strader, Building Inspector, said he had no problem or questions regarding the request.

REMONSTRATORS

None.

Board Attorney Dale Coffey read the Findings of Fact, and they were found to be acceptable.

MOTION: Katie Barnard made a motion to accept the Development Standards Variance to construct a single-family home across the lot line (reduced setback) on Lot 4 and Lot 5 in the Wolf Laurel Ridge Estates as requested by Kevin Shingleton. This means vacating a lot and creating a new lot according to the Findings of Fact. The motion was seconded by Anna Elliott and passed unanimously.
