Board of Zoning Appeals Meeting Minutes – September 27, 2022

The Martinsville Board of Zoning Appeals was called to order by Chairman Anna Elliott at 6:00 PM on Tuesday, September 27, 2022, in the Council Chambers of City Hall, Martinsville, IN.

ATTENDANCE

Those members present were:

Chairman Anna Elliott; Vice-Chairman Katie Barnard; Secretary Marilyn Siderewicz;   Tom Hacker; and Dessen Miller.

Also in attendance:  Bob Strader, Building Inspector
Dale Coffey, Board Attorney

MINUTES:    A motion was made by Katie Barnard to approve the minutes of the August 23, 2022, meeting.   This motion was seconded by Tom Hacker and passed unanimously.

NEW BUSINESS:

A. Docket #BZA22013: Development Standards Variance request to reduce:

  1. front lot setback from 30’ to 16.5’
  2. side lot setback from 6’ to 5’
  3. rear lot setback from 30’ to 22’

The lot is located at 290 West Columbus Street.  Owner is Susan Oliver.

County Commissioner Bryan Collier made the presentation to the Board.  Mr. Collier stated that the request centers on a home located at 290 West Columbus Street.   The owner of the property, Susan Oliver, has agreed to sell the parcel to the county contingent on the variance requests’ approval.   This lot will be used to complete the parking lot that is being constructed west of the county’s administration building.

The Findings of Fact were read by Attorney Dale Coffey.

REMONSTRATORS:    None.

MOTION:   Dessen Miller moved to approve the Development Standards Variance request to reduce the front lot setback from 30’ to 16.5’   The motion was seconded by Tom Hacker and passed unanimously.

MOTION:   Dessen Miller moved to approve the Development Standards Variance request to reduce the Side lot setback from 6’ to 5’.   The motion was seconded by Tom Hacker and passed unanimously.

MOTION:   Dessen Miller moved to approve the Development Standards Variance request to reduce the rear lot setback from 30’ to 22’.  The motion was seconded by Katie Barnard and passed unanimously.

OTHER BUSINESS:    Discussion of 2023 Meeting Calendar.

All members of the Board were in agreement to continue meeting on the fourth Tuesday of the month at 6:00 PM. with exceptions for the holidays if needed.

MOTION:  Marilyn Siderewicz motioned to continue meeting on the fourth Tuesday of the month at 6:00 PM. with exceptions for holidays if needed.  The motion was seconded by Tom Hacker and passed unanimously.

NEXT SCHEDULED MEETING:    The next regularly scheduled meeting of the Martinsville Board of Zoning Appeals will be Tuesday, October 25, 2022, at 6:00 PM.

ADJOURNMENT:  There being no further business, the meeting adjourned with a motion made by Katie Barnard, seconded by Dessen Miller, and passed unanimously.
