Board of Zoning Appeals Meeting Minutes – February 28, 2023

Board Of Zoning Appeals

In the absence of the chairman, Marilyn Siderewicz, Secretary, called the meeting of the Martinsville Board of Zoning Appeals to order at 6:00 PM on Tuesday, February 28, 2023, in the Council Chambers of City Hall, Mai1insville, IN.

ATTENDANCE

Those members present were:
Secretary Marilyn Siderewicz; Dressen Miller, and Tom Hacker.

Also in attendance: Glenn Cook, Attorney, Substituting for Dale Coffey Bob Strader, Building Inspector

APPOINTMENT OF OFFICERS FOR YEAR 2023:

CHAIRMAN: Dressen Miller made a motion to elect Anna Elliott as Chairman of the BZA Board for the year 2023. The motion was seconded and passed unanimously.

VICE-CHAIRMAN: Marilyn Siderewicz made a motion to elect Dressen Miller as Vice-Chairman of the BZA Board for the year 2023. The motion was seconded and passed unanimously.

SECRETARY: Tom Hacker made a motion to elect Marilyn Siderewicz as Secretary of the BZA Board for the year 2023. The motion was seconded and passed unanimously.

MINUTES: A motion was made by Dressen Miller to approve the minutes of the October 25, 2022, meeting. This motion was seconded by Tom Hacker and passed unanimously.

NEW BUSINESS:

Docket #BZA23003: Development Standard Variance request to increase the height of a free-standing pylon sign from 40′ to 90′; Location: 1201 S. Ohio St.; PID #55-13-04- 490-002.001-021; Legal Description: Pt Lot I For Bare Feet Minor Plat 2.01 acres; Owner: FBF Real Estate Investment LLC; presented by Michael Ksenak, Attorney for K&J Acquisitions, LLC and/or K&J Investments XXXI, LLC (Culver’s requested)

Attorney Michael Ksenak made the presentation to the BZA Board. The request from Culver’s was to allow a 90-foot-tall sign on their prope11y. The city’s current zoning ordinance limits signs to 40 feet. The company requested the additional height so it could be seen from the highway,

MOTION: Dressen Miller made a motion to allow the Development Standard Variance request for a free-standing pylon sign from 40 ft to 90 ft, at 1201 South Ohio Street, as requested by Culver’s. The motion was seconded by Tom Hacker and passed unanimously,
OLD BUSINESS: None.

NEXT SCHEDULED MEETING: The next regularly schedule d meeting of the Martinsville Board of Zoning Appeals will be Tuesday, March 28, 2023 , at 6:00 PM.

ADJOURNMENT: There being no further business , the meeting adjourned with a motion by Tom Hacker and seconded by Dressen Miller .
