In the absence of a Chairman and Vice-Chairman, Secretary Marilyn Siderewicz, called the meeting of the Martinsville Plan Commission to order at 7:00 PM on Tuesday, February 28, 2023, in the Council Chambers of City Hall, Martinsville, IN.
SWEARING IN CEREMONY: Mayor Kenny Costin performed the Swearing In Ceremony for the new members of the Martinsville Plan Commission.

APPOINTMENT OF OFFICERS:
CHAIRMAN: Ann Miller made a motion to elect Richard Bastin as Chairman of the Plan Commission. The motion was seconded by Joe Disney and passed unanimously.
VICE-CHAIRMAN: Alan Arnold made a motion to elect Alan Arnold as Vice Chairman of the Plan Commission. The motion was seconded by Ann Miller and passed unanimously.
SECRETARY: Ann Miller made a motion to elect Marilyn Siderewicz as Secretary of the Plan Commission. The motion was seconded by Richard Bastin and passed unanimously.
PRESENTATION OF MINUTES: Dated January 24, 2023.
MOTION: A motion was made by Ann Miller and seconded by Joe Disney to approve the minutes of the January 24, 2023, meeting of the Plan Commission. This motion passed unanimously.
1. Docket #PC23001: Request to subdivide property into two lots to be known as Lot 1 and Lot 2 BLP Minor Plat – Minor Plat Request -Address: 290 E. Sumner Avenue; Legal Description: Lot 1, Block 6, Mitchell’s Addition; PID: 55-13-04-256- 010.000-021; Owner: Big League Properties; presented by Drapalik Surveying & Engineering – Ross Drapalik.
Ross Drapalik made the presentation to the Plan Commission. Mr. Drapalik stated that the owner would like to split the lot at 290 E. Sumner. The property is zoned Residential Two which allows for doubles or apartments to be constructed on the property. Currently there is a single-family home and a detached garage on the lot. The owner would like to split the garage off from the home so it could be sold.
A couple of neighbors expressed concerns about what a new owner might do with the garage, where the vehicles might park, and future noise problems.
MOTION: Ann Miller made a motion to deny Docket #PC23001 its request. The motion was seconded by James Burkhart and passed unanimously.
2. Docket #PC23002: Zoning Map Change Request -Address: 1201 S. Ohio Street; Legal Description: Part of Lot 1 For Bare Feet Minor Plat 2.01 acres; PID: 55-13-0n4-490-002.001-021; Owner: FBF Real Estate Investment LLC; Requested by K&J Acquisitions, LLC and/or K&J Investments XXI, LLC; presented by Ksenak Law Firm – Mike Ksenak.
Attorney Mike Ksenak made the request to the Commission. Mr. Ksenak said Culver’s was planning to purchase two acres of land at the intersection of South Ohio Street and Prather Drive. The property needed to be rezoned from its current classification oflndustrial 2 to Business 3.
One neighbor expressed concerns the project could add to drainage problems in the area. He said the property is in a floodway and like other new businesses in the area will be built on an elevated pad.
He was told by the city that they will have to meet the requirements of the city’s drainage ordinance and they will not be allowed to dump their storm water onto neighbors.
MOTION: Ann Miller made a motion to approve a recommendation to the City Council for a zoning map change at 1201 S Ohio Street as requested by K&J Acquisitions, LLC and/or K&J Investments XXI, LLC. The motion was seconded by Rick Durual and passed unanimously.
